Terms & Conditions

Please read these Terms and Conditions carefully before placing an order.

1. Scope and Acceptance

These Terms and Conditions apply to all orders placed through our website. By placing an order, you agree to be bound by these terms. The contract between you and us is formed when we send you an order confirmation email.

2. Products and Prices

We sell physical art prints of original drawings, made-to-order in standard sizes.

All prices are displayed in Swiss Francs (CHF) and include all applicable taxes (where required). The final consumer price is the same regardless of your location.

For region-specific tax and pricing details, see Section 12 (Regional Variations).

3. Order Process

When you place an order, you are making an offer to purchase. We will send you an order confirmation email, which constitutes our acceptance of your offer and forms a binding contract.

We reserve the right to reject orders in exceptional circumstances (for example, pricing errors or unavailability).

4. Payment

Payment is by credit card only, processed through our secure payment processor. It is due immediately when you place your order. We will begin processing your order once payment has been successfully received.

5. Delivery

Free shipping is provided to all addresses in the European Union, Switzerland, United Kingdom, and United States.

Delivery time: 5-14 working days from order confirmation (varies by location).

Your art print is fulfilled by our trusted third-party printers located in your region. Once your order is handed over to the shipping carrier, the risk of loss or damage transfers to you.

Delivery to Switzerland: Your order will be fulfilled and shipped from our printer in Germany. Orders may be subject to Swiss customs duties and VAT upon delivery, payable by you. Whether charges apply depends on the value declared by the printer.

6. Right of Withdrawal

You have a 14-day voluntary right of withdrawal from the date you receive your goods.

How to withdraw:

  • Notify us in writing (email is acceptable) within 14 days of receiving your order
  • We will send you the return address by email
  • You are responsible for return shipping costs
  • Goods must be unused, in original condition, and in original packaging

Refund:

  • We will refund the purchase price within 7 days of receiving and inspecting the returned goods
  • The refund will be processed to your original payment method
  • We may reject returns of used or damaged products

Note for EU customers: This voluntary withdrawal right is in addition to your statutory consumer rights under EU law, which remain fully applicable.

7. Warranty

You have a 2-year statutory warranty for material defects or defects in workmanship.

If you discover a defect, please report it to us within 14 days of delivery. We will remedy the defect through repair, replacement, or refund at our discretion.

The warranty does not cover damage resulting from improper handling, storage, framing, or use of the product.

8. Limitation of Liability

We are fully liable for:

  • Injury to life, body, or health caused by us
  • Damage caused by our intent or gross negligence
  • Product defects covered under statutory warranty

Our liability is limited or excluded for:

  • Force Majeure: We are not liable for non-performance due to events beyond our control, such as war, natural disasters, strikes, government orders, or other unforeseeable circumstances
  • Third-party delays: We are not liable for delays caused by postal services, shipping carriers, customs authorities, or our printer that are beyond our control.
  • Colour variations: Minor differences between how colours appear on your screen and the final print are normal due to technical limitations and do not constitute a defect. We are only liable if the print significantly differs from what you ordered.
  • Technical issues: We do not guarantee continuous website availability and may cancel orders affected by obvious pricing errors or system malfunctions.
  • Copyright violations: You are liable for any unauthorized reproduction of the artwork.
  • Customer responsibility: We are not liable for damage caused by improper handling, storage, framing, or an incorrect shipping address provided by you.
  • Product representation: Product images on our website are illustrative and may vary slightly from the actual print.

9. Intellectual Property

All artwork sold on our website is protected by copyright, which remains with the artist.

When you purchase a print:

  • You receive the physical print only
  • You do NOT receive reproduction rights or copyright
  • You may resell the physical print you purchased
  • You may NOT reproduce, copy, or commercially exploit the artwork in any way

10. Data Protection

We collect personal data only as necessary to process your order (name, address, email, payment information).

Your data is processed in compliance with Swiss Federal Act on Data Protection (FADP) and the EU General Data Protection Regulation (GDPR).

We share your data only with our printer, payment processor, and shipping carrier as needed to fulfil your order.

11. Applicable Law and Jurisdiction

Swiss law applies to all contracts, with the place of jurisdiction in Basel, Switzerland.

For region-specific legal rights and jurisdictions, see Section 12 (Regional Variations).

12. Regional Variations

The following region-specific rules apply in addition to the general terms above:

Switzerland

  • Taxes: No Swiss VAT is charged on orders
  • Warranty: 2-year statutory warranty under Swiss law
  • Consumer Rights: Swiss consumer protection law applies
  • Governing Law: Swiss law and jurisdiction in Basel, Switzerland

European Union (all EU countries)

  • Taxes: VAT is included in the displayed price (rate varies by country according to EU regulations)
  • Right of Withdrawal: 14-day withdrawal right is your statutory right under EU Consumer Rights Directive. Our policy meets these requirements.
  • Warranty: 2-year statutory warranty under EU law
  • Consumer Rights: Your mandatory consumer protection rights under the law of your country of residence remain fully applicable and cannot be waived
  • Dispute Resolution: For online disputes, you may use the European Commission’s Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr
  • Governing Law: Swiss law applies to the contract. However, you retain the right to bring legal proceedings in the courts of your country of residence, and your mandatory consumer rights under your country’s law cannot be restricted

United Kingdom

  • Taxes: UK VAT (20%) is included in the displayed price
  • Right of Withdrawal: 14-day withdrawal right is your statutory right under UK Consumer Contracts Regulations 2013. Our policy meets these requirements.
  • Warranty: 1-year warranty against defects in materials and workmanship. Your statutory rights under UK Consumer Rights Act 2015 remain unaffected.
  • Consumer Rights: Your mandatory consumer protection rights under UK law remain fully applicable and cannot be waived
  • Governing Law: Swiss law applies to the contract. However, you retain the right to bring legal proceedings in UK courts, and your mandatory consumer rights under UK law cannot be restricted

United States

  • Taxes: Applicable state and local sales taxes will be calculated and displayed at checkout, where required.
  • Right of Withdrawal: Our 14-day return policy is voluntary. US law does not mandate withdrawal rights for distance sales.
  • Warranty: 1-year warranty against defects in materials and workmanship. This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.
  • Consumer Rights: Some states do not allow the exclusion or limitation of certain warranties or consequential damages. In such cases, our liability limitations are restricted to the maximum extent permitted by your state law.
  • Governing Law: These Terms are governed by Swiss law. However, you retain any mandatory consumer protection rights under your state law. Disputes may be resolved in the courts of Basel, Switzerland, or in courts of competent jurisdiction in your state, as permitted by applicable law.
  • California Residents: California Civil Code Section 1789.3 requires us to inform California residents that they may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Sacramento, CA 95834, or by telephone at (916) 445-1254 or (800) 952-5210

12. Changes to Terms

We may update these Terms and Conditions from time to time. Changes will apply to orders placed after the update date. The current version with the update date is always available on our website.

13. Severability

If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable. Invalid provisions will be replaced by applicable statutory provisions.
